Job Description:

Under the direction of the General Counsel, the Public Records Attorney analyzes, processes, and responds to public records requests submitted to the Secretary of State's Office (SOS). The Public Records Attorney, in coordination with the General Counsel, evaluates whether any record or part thereof is exempt from disclosure and redacts records as necessary. The Public Records Attorney provides research and advice to the General Counsel on a variety of matters related to the Office. This position may assist with other responsibilities as assigned by the General Counsel.
Examples of Work
•Receive, process, and respond to requests for public records in compliance with the Nebraska Public Records Laws and other applicable laws
•Compose, format, and prepare correspondence
•Maintain public records request tracking system to monitor timely review and response to requests
•Communicate with SOS divisions and staff to identify responsive records
•Review responsive records for exempt information and apply redaction prior to release
•Maintain appropriate records regarding redacted records
•Review email archives for email communication responsive to requests
•May assist with the development and implementation of a digital content management system or records request system
•May assist with the development and implementation of policies or guidelines or other content that will facilitate the records request process
•Perform legal research related to functions of the SOS



Requirements / Qualifications:




Minimum Qualifications: Graduation from an accredited school of law. Must be licensed to practice law in Nebraska, eligible and willing to become licensed to practice law in Nebraska, or have the clear ability to be licensed in Nebraska by motion, with training and/or experience that will enable the incumbent to possess the required knowledge, abilities, and skills. Work experience coordinating or administering public disclosure activities OR a combination of education, training and practical experience which provides an equivalent background required to perform the work of the position.



Knowledge, Skills and Abilities



Knowledge of the Nebraska Public Records Laws. Extensive knowledge of modern office practices, procedures, and equipment.


Ability to interpret and apply statutes, case law, decisions of court/administrative hearings, administrative rules, and policies on a variety of legal issues; review and apply state and federal laws regarding agency compliance.


Demonstrate skills critical for success including sound judgment, critical thinking, ethical behavior, initiative, decisiveness, flexibility, and planning. Organize and work independently on multiple assigned tasks/projects, complete assignments within specified deadlines. Work well under pressure. Balance competing demands of long-term projects and emergent needs. Maintain confidentiality. Study and apply new information. Demonstrate project management skills. Establish and maintain cooperative and effective working relationships with supervisors, staff, and the general public. Communicate clearly and concisely, both orally and in writing, with tact and courtesy.
